A Florida report revealed that a five-year-old girl fell off a Disney Dream cruise ship in June while posing for a photo on a porthole railing at her mother’s request. The Broward County Sheriff’s Office termed the incident “avoidable” in a report filed the day after the accident, which occurred as the ship was returning from the Bahamas to Port Everglades in Fort Lauderdale.
Although the state attorney criticized the mother’s role in facilitating the photo as “arguably negligent and irresponsible,” no criminal charges were filed. The incident gained global attention when both the child and her father were rescued by the cruise ship staff, with dramatic footage captured by passengers and shared on TikTok.
Security footage established that the family was on deck four when the mother gestured towards the railing where the child was sitting. The girl lost her balance and fell about 49 feet into the water, prompting her father to jump in after her approximately 45 seconds later.
The ship’s rescue boat successfully retrieved both the child and her father from the water by 11:49. The child suffered from hypothermia, while her father sustained a spinal fracture.
Although the police deemed the fall as “avoidable,” the state attorney’s office decided not to press charges, citing that the mother’s actions, while negligent, did not meet the threshold for criminal negligence. Instances of passengers falling overboard are rare, with statistics indicating that only a small fraction of passengers and crew members have fallen overboard in the past decade.
In a separate statement, the detective noted that the lack of a barrier on the open window contributed to the accident, but ultimately, the case was closed without charges being filed.
