Two Crown attorneys in Hamilton committed significant errors during a murder trial leading to a rare judicial stay by a Superior Court justice. The stay halted all proceedings and resulted in the accused, Salomon Bashir, being acquitted of the second-degree murder charge of Everton Frost. Justice Giulia Gambacorta granted the stay, expressing concerns about the prosecutors’ and police’s lack of diligence, which compromised Bashir’s right to a fair trial.
Gambacorta highlighted two critical mistakes made by assistant Crown attorneys Michael Dean and Steve Kim. They failed to disclose crucial DNA and cellphone tower evidence to the defense before the trial, leaving Bashir’s legal team unprepared. The judge deemed this repeated indifference as an abuse of the judicial process, justifying the rare judicial stay.
The arrest of Bashir in connection with Frost’s shooting death in December 2022 led to the discovery of DNA evidence on a surgical mask believed to be worn by the perpetrator. While Bashir’s DNA was not found on the mask, a match was identified for Frost’s brother. The police held onto this vital evidence without informing the Crown’s office until much later and only disclosed it to the defense on the second day of the trial.
Additionally, the Crown failed to share cellphone tower data crucial for connecting Bashir to the crime scene. This complex evidence required expert explanation through a cellphone tower map, which the Crown delayed obtaining until the trial had already commenced. Following the revelation of these oversights, the defense sought a stay of the proceedings, which the Crown opposed, advocating for a mistrial and a new trial instead.
Nevertheless, Gambacorta ruled in favor of the judicial stay, citing the Crown’s conduct and Bashir’s prolonged pretrial detention. The defense lawyers lamented the lack of interest displayed by the Crown’s office and emphasized the importance of upholding fair trial rights and public confidence in the justice system.
Notably, this decision marks a rare instance of a murder charge being stayed due to an abuse of process in Ontario, underscoring the significance of maintaining accountability and fairness in legal proceedings involving serious offenses.
